Dumping Investigation on Chinese Made Saddles (updated for 2009)
MAARSSEN, The Netherlands - On April 7, 2006 the Official Journal of the European Union published the: ‘Notice of initiation of an anti-dumping proceeding concerning imports of certain saddles originating in the People's Republic of China’. The dumping complaint was lodged on 22 February 2006 by the European Saddle Manufacturers Association (ESMA). The association is chaired by Pietro Nigrelli, who is also secretary general of the bicycle division of ANCMA, the Italian two-wheel industry association. According to the Official Journal Notice, the ESMA made the complaint: “On behalf of producers representing a major proportion, in this case more than 90%, of the total Community production of certain saddles.”
About the specific products involved in the investigation the Official Journal Notice says: “The product allegedly being dumped is saddles and essential parts thereof (bases, cushions or covers), of bicycles and other cycles (including delivery tricycles), whether or not motorized and with or without sidecars, of fitness machines and of home trainers, originating in the People's Republic of China (‘the product concerned’), normally declared within CN codes 8714 95 00, ex 8714 99 90 and ex 9506 91 10.”
According to the C 84/4 Notice, the ESMA provided evidence that imports of the product concerned from the People's Republic of China have increased overall in absolute terms and in terms of market share. The Notice further stipulates: “It is alleged that the volumes and the prices of the imported product concerned have, among other consequences, had a negative impact on the market share held, the quantities sold and the level of prices charged by the Community industry, resulting in substantial adverse effects on the overall performance, the financial situation and the employment situation of the Community industry.”
If the Commission believes that provisional measures to temporarily remedy the effects of dumping are necessary, then these should be promulgated before January 7, 2007, whereas the investigation must be concluded before 7 July 2007. Upon submission of the Commission’ proposal, the Council has one month to take a final decision.
