HEEREVEEN, Netherlands (December 2) – The court in Leeuwarden has ruled that Mr. Vriend owner of Bike Motion.NL, a discount internet bike shop, has the right to sell Batavaus branded bikes, although he is no longer a franchise dealer. Mr, Vriend has been a Batavus dealer for more than 30 years, but the relation was terminated by Batavus in 2001. Since then, Bike Motion.NL has been selling Batavus branded bikes which were supplied to him by franchised dealers. Since September 1st 2004, Batavus has a ‘selective dealer policy’ which pascal means that they can decide who can sell Batavus bikes and who can’t. But in this particular case, the judge ruled, considering the history of the case that Batavus was not allowed to cease delivery to Mr. Vriend. The basis of the selective delivery systeem though, was not under discussiant by the court, which is a very positive side effect to this case. Batavus will continue therefore, with the new systeem, and has appealed against this particular ruling.
