THE HAGUE, Netherlands (Nov 29) – The Dutch bike makers that were fined by the NMa ( trade watch dog) Batavus, Gazelle & Giant, on the charge of forming a cartel, have seen their hefty fines reduced. For Accell (Batavus & Koga etc) the fine was lowered from € 12.8 million to 11.5 million. Gazelle now faces € 11.6 million (was € 12.9 million), and Giant still has to pay € 3.4 million (formerly 3.9 million). The fines have been lowered because the NMa made a form-fault in the charging. An independent objection commission has retified this mistake. The NMa is still convinced that the bike makers are ‘guilty’ of making illegal price deals...A fine reduction is unheard of in jurisprudence, and does put some question marks around the whole matter.(MH)
